Agreement to Terms

By accessing and using Zero Digit's website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you should not use our website or services.

Services Description

Zero Digit provides website development and digital services including but not limited to:

• Website design and development
• E-commerce solutions
• Enterprise application development
• Website hosting and maintenance
• Technical support and consulting

Service availability, features, and pricing are subject to change at our discretion.

Account Registration

To access certain features of our services, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.

Free Website Package

• Limited to 5 pages
• Basic features and functionality
• Standard support
• Subject to availability and our acceptance

E-Commerce Package

• Monthly subscription at $499/month
• Includes specified features as outlined in your service agreement
• Billed monthly in advance
• Subject to minimum commitment period

Enterprise Solutions

• Custom pricing based on requirements
• Detailed in separate service agreements
• Subject to project scope and specifications

Payment Terms

All payments are processed through Stripe, our secure payment processor. By making a payment, you agree to:

• Provide valid payment information
• Authorize automatic recurring payments for subscription services
• Pay all applicable fees and charges
• Be responsible for any payment processing fees

Subscription fees are billed in advance on a monthly basis. Failure to pay may result in service suspension or termination.

Refund Policy

Refunds are handled on a case-by-case basis and are subject to the following conditions:

• Refund requests must be submitted within 14 days of the initial payment
• Services must not have been fully delivered or utilized
• Custom development work is non-refundable once commenced
• Monthly subscription fees are non-refundable

We reserve the right to determine refund eligibility at our sole discretion.

Cancellation and Termination

Client Cancellation

You may cancel your subscription at any time by:

• Contacting our support team
• Using the cancellation feature in your account dashboard

Cancellations are effective at the end of the current billing period. You will continue to have access to services until that time. No partial refunds are provided for unused portions of the billing period.

Our Right to Terminate

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for:

• Violation of these Terms and Conditions
• Fraudulent or illegal activities
• Non-payment of fees
• Abusive behavior towards our staff or systems
• Any reason we deem necessary to protect our business or other clients

Intellectual Property Rights

Our Content

All content on our website, including text, graphics, logos, images, and software, is the property of Zero Digit or its licensors and is protected by copyright and intellectual property laws.

Client Content

You retain ownership of all content you provide to us. By providing content, you grant us a license to use, modify, and display your content as necessary to provide our services.

Deliverables

Upon full payment, you receive ownership of the final deliverables as specified in your service agreement. We retain the right to:

• Display completed work in our portfolio
• Use project screenshots for marketing purposes
• Retain copies for our records

Client Obligations

As a client, you agree to:

• Provide timely feedback and approvals
• Supply necessary content, assets, and access
• Ensure all provided content is legal and properly licensed
• Respond to communications within reasonable timeframes
• Make timely payments as agreed
• Comply with all applicable laws and regulations

Failure to meet these obligations may result in project delays or additional charges.

Service Level and Uptime

While we strive to provide reliable services with maximum uptime, we cannot guarantee uninterrupted service. Downtime may occur due to:

• Scheduled maintenance
• Emergency repairs
• Third-party service disruptions
• Force majeure events
• Technical issues beyond our control

We will make reasonable efforts to notify you of scheduled maintenance in advance.

Warranty and Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

We do not warrant that our services will meet your specific requirements or that any defects will be corrected, although we will make reasonable efforts to do so.

Limitation of Liability

To the maximum extent permitted by law, Zero Digit shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from your use or inability to use our services
• Damages caused by third-party services or content

Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Zero Digit, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these terms
• Your violation of any third-party rights
